Terms of use — Save with Jan Aushadhi

1. What this agreement is

These terms are between you and Valuecreate Ventures LLP, registered at ⚠ TO BE COMPLETED BEFORE PUBLISHING ("we", "us"). They govern your use of the Save with Jan Aushadhi mobile app and the website at https://savewithjanaushadhi.valuecreateventures.com (together, "the service"). By using the service you accept these terms. If you do not accept them, do not use the service.

Our Privacy notice forms part of these terms.

2. What the service does, and what it does not do

The service is an information service. It tells you whether a Jan Aushadhi medicine exists with the same salts at the same strengths as a medicine you name, what each costs according to our data, and where Jan Aushadhi Kendras are.

The service does not:

• give medical advice, or replace a doctor, pharmacist or any other qualified professional;
• prescribe, recommend, substitute, sell, dispense, deliver or store medicines;
• guarantee that a medicine is appropriate for you, or that two medicines are clinically interchangeable in your particular case;
• guarantee that a price shown is the price you will be charged, or that a Kendra has stock.

A composition match is not a prescription. The app matches published salt names and strengths. Whether you should take a particular medicine is a clinical judgement that depends on your history, your other medicines, the formulation, and things the app cannot know. Always consult your doctor or pharmacist before changing, starting or stopping any medicine. In an emergency, contact a doctor or emergency service, not this app.

3. Eligibility and accounts

You may use the search and Kendra features without an account.

Where we have enabled phone login, an account requires a working Indian mobile number, and you must be 18 or older. You agree that the number you enter is yours and that you may receive service messages on it. You are responsible for what happens through your account and for keeping access to your number secure. Tell us at ⚠ TO BE COMPLETED BEFORE PUBLISHING if you think someone else is using your account.

We may suspend or close an account that is being used to abuse the service, to scrape it, or to break the law.

Consent to share your number. If you separately opt in, we pass your number to registered Jan Aushadhi Kendra partners so they can help you obtain your medicines. That consent is optional, the service works without it, and you can withdraw it at any time in your profile. A Kendra partner that already holds your number is an independent business and is responsible for its own use of it; withdrawal stops further sharing but cannot retrieve what is already held.

4. Data accuracy

We take reasonable care with the data behind the service, and we tell you how old our price data is. Even so:

• prices, product codes and pack sizes change, and the source lists are revised;
• Kendra addresses, phone numbers and opening hours change, and Kendras close;
• our mapping between a branded medicine and a Jan Aushadhi medicine is our own reading of published composition data, and may contain errors or gaps;
• distances shown are straight-line unless the screen says otherwise, and a road route will be longer.

Use the service as a starting point, not as a final authority. Tell us about an error at ⚠ TO BE COMPLETED BEFORE PUBLISHING and we will look at it.

5. Independence — no government affiliation

We are an independent private service. We are not affiliated with, endorsed by, appointed by, or operated by the Pradhan Mantri Bhartiya Janaushadhi Pariyojana (PMBJP), the Pharmaceuticals & Medicines Bureau of India (PMBI), the Department of Pharmaceuticals, or any government body. We do not act for any Kendra, and no Kendra acts for us. References to the Jan Aushadhi scheme, to Kendras, and to medicine brand names are descriptive and nominative; the marks belong to their owners.

6. Advertising and sponsored placements

The service is free and carries advertising and paid Kendra placements. We label them. Sponsorship buys position in a list and nothing more: it never changes a price we show, a composition match, a rating, or a distance, and it never suppresses a genuinely nearer Kendra. We are not responsible for goods or services offered by an advertiser, and dealing with an advertiser is between you and them.

Where we point you to an online pharmacy because no Kendra is near you, that is a referral. The purchase, the price, the delivery and any dispute are between you and that pharmacy, on their terms.

7. Ratings and anything you submit

If you rate a Kendra, report an error or send us a suggestion, you confirm it is your own honest view, that it is not defamatory, obscene, or unlawful, and that it does not contain someone else's personal data. You give us a free, worldwide, non-exclusive licence to use, display and adapt that content in the service. We may remove content that breaks these terms. We do not accept paid or incentivised ratings, and a Kendra cannot buy a score.

8. How you may use the service

You may use it for your own personal, non-commercial purposes. You may not:

• copy, scrape, mirror or bulk-extract our catalogue, price data or Kendra listings, by hand or by machine;
• resell, sublicense or redistribute any part of the service;
• reverse-engineer, decompile or interfere with it, or attempt to access another user's data;
• use it to give medical advice to someone else as if it were professional advice;
• misrepresent it as a government service.

9. Our intellectual property

The app, the website, our name, the marigold-and-green mark, the interface, the copy, the Learn material and our compiled data are owned by us or licensed to us. These terms give you a personal, revocable, non-transferable licence to use the service as published. Nothing else is granted. Third-party medicine brand names and the Jan Aushadhi name belong to their respective owners.

10. Availability and changes

We may change, suspend or withdraw any part of the service, add or remove features, or switch phone login on or off, at any time. We aim to give notice of a material change, and we will not make a change that retroactively affects consent you have already given without asking you again. The service may be unavailable during maintenance or through no fault of ours. It is not intended for use in emergencies.

11. Liability

The service is provided "as is". To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for: a clinical outcome arising from a decision you took using the service; a price or availability difference at a counter; the acts of a Kendra, a pharmacy, an advertiser or any other third party; or indirect, incidental or consequential loss, including lost savings or lost profit. Where liability cannot be excluded, our total liability to you for all claims is limited to ₹5,000, reflecting that the service is provided to you free of charge.

12. Indemnity

You will indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms or your unlawful use of the service.

13. Ending this agreement

You may stop using the service at any time, and delete your account from your profile or at https://savewithjanaushadhi.valuecreateventures.com/delete-account. We may end your access if you materially breach these terms. Clauses 4, 5, 9, 11, 12 and 14 survive termination.

14. Governing law and disputes

These terms are governed by the laws of India. Before going to court, write to ⚠ TO BE COMPLETED BEFORE PUBLISHING with the detail of the dispute; we will try to resolve it within 30 days. Failing that, the courts at ⚠ TO BE COMPLETED BEFORE PUBLISHING have exclusive jurisdiction.

15. General

If a clause is unenforceable, the rest stands. Our not enforcing a right is not a waiver of it. You may not assign these terms; we may assign them to a group company or on a sale of the business. These terms and the Privacy notice are the whole agreement between us about the service.

16. Grievances

Grievance Officer: ⚠ TO BE COMPLETED BEFORE PUBLISHING, ⚠ TO BE COMPLETED BEFORE PUBLISHING, ⚠ TO BE COMPLETED BEFORE PUBLISHING. We acknowledge within 48 hours and resolve within 30 days.
